Global United Nations Constitution

Preamble

We, the nations of the Global United Nations (GUN) hereby declare our solidarity as a cadre of nations bound by common goals. Those goals are of the common defense, cooperative prosperity, education, and respect for all nations.

History

GUN was founded on 12 May 2007 by Emperor Zhaan of Darfazia and Mglockwo of Titea. They envisioned an alliance built on the principles of peace and diplomacy to advance the social and economic status of its members while ensuring their security.

In the year since its inception, GUN has seen enormous growth, established friendships across the CyberNations community and recently has experienced internal turmoil and large scale war. This Constitution is designed to address our identified weaknesses in GUN while leveraging our proven strengths.

Structure

The Global United Nations shall be composed of four main bodies:

I. General Assembly (GA)

II. GUN University Student Body (Uni)

III. High Council (HC)

IV. Security Council (SC)

A system of checks and balances shall exist between the organs to ensure effective and proper execution of responsibilities for the members of each organ.

I. The General Assembly

The General Assembly (GA) is comprised of all GUN members who have successfully been admitted into GUN. It is the final authority to which all GUN members are held responsible.

Members of the GA shall abide by this Constitution at all times and shall not violate the rules of CyberNations. GA members shall not be part of any other Alliance. GA Members shall be civil and respectful to all members of GUN and CN. GA members shall not join any forum for the purpose of "spying" on any other Alliance in order to benefit their own nation or the entirety of GUN. GA members shall not falsely represent themselves in any way (either as government officials or as another CN player entirely). GA members shall not engage in "Rogue" behavior by making Declarations of War without proper approval.

II. The GUN University Student Body

The GUN University Student Body (Uni) is comprised of all members who have been accepted under the GUN banner, but have not been accepted to the General Assembly. This group is in a learning phase to provide them a basic understanding of CyberNations and GUN's Constitution. Some applicants to GUN will be allowed to bypass this group and directly enter the General Assembly based upon their experience in the game, at the sole discretion of GUN.

III. The High Council

The High Council (HC) is comprised of subsidiary organs that define the functional branches of GUN: the Ministry of Defense (MoD), Ministry of Finance (MoF), Ministry of Foreign Affairs (MoFA) and Minstry of Domestic Affairs (MoDA). Each Ministry is lead by a Minister, who is solely responsible for conducting activities in their Ministry to meet the responsibilities assigned to it in this Constitution. The Ministers are also responsible to ensure that the policies delineated by the Security Council, where not in conflict with this Constitution, are carried out effectively.

Each Minister may appoint Deputies as he/she believes appropriate and delegate responsibilities as he/she deems appropriate for the efficient execution of their Ministry's responsibilities.

The Ministry of Defense is responsible for maintaining the security of GUN. MoD shall maintain the military preparedness of GUN, identify threats to GUN security and stand ready to respond to the call for the use of military force. MoD shall organize the military to ensure the capacity for a military response to threats. MoD shall identify and enforce means to minimize damage should GUN members be attacked. MoD shall monitor the status of the security of GUN nations to ensure a timely response to attacks. Upon being tasked to use military force, the MoD is responsible for ensuring a timely, effective military campaign to neutralize the threat.

The Ministry of Finance is responsible for maintaining the financial infrastructure of GUN. The MoF shall manage all aid programs within GUN to include (but not limited to) Starter Aid and War Aid. The MoF shall ensure that programs exist to aid in the economic development of GUN member nations and shall define those mechanisms to the General Assembly to ensure that all GUN members understand what economic support is available. The MoF shall create and maintain a financial infrastructure capable of responding to larger scale demands upon GUN assets (such as an Alliance war).

The Ministry of Foreign Affairs is responsible for forging and maintaining relations with all entities external to GUN. The MoFA shall create and maintain Embassies in other alliances as well as manage the Embassies of foreign alliances within GUN. The MoFA shall be responsible for commmunicating with external alliances to resolve conflicts which arise due to Declarations of War, Spy Operations or Foreign Aid. The MoFA shall report all irresolvable conflicts with external Alliances to the SC. The MoFA shall report all irresolvable conflicts that do not involve external alliances to the MoD for military resolution. The MoFA shall be the point of contact for all treaty discussions and shall present such opportunities to the SC for consideration. The MoFA shall keep the SC informed of all activities external to GUN which are of importance in policy making decisions.

The Ministry of Domestic Affairs is responsible for maintaining the membership of GUN. The MoDA shall be responsible for managing recruitment of new members. The MoDA shall be responsible for the creation and maintenance of all education programs. The MoDA shall be responsible for ensuring proper membership activity and ensuring the appropriate correlation between in-game Global United Nations AA nations and actual GUN forum membership.

IV. The Security Council

The Security Council (SC) is comprised of three (3) elected leaders and is responsible for creating, communicating and managing the strategic vision for GUN by defining policies which the Ministries must carry out. The Security Council shall maintain a publicly available, documented form of GUN Policies that define the responsibilities they have conveyed upon the Ministers.

The SC may appoint Executive Assistants and create subordinate committees as they believe appropriate to support them in their responsibilities.

The SC shall be responsible for reviewing all Treaty recommendations from the MoFA. The SC may rule on the signing of any treaty that is not binding upon GUN to militarily or economically support an Alliance/nation at a time when that Alliance/Nation is at war. SC may elect for a GA vote to ratify a treaty they would otherwise have authority to rule upon, but SC is required to allow GA ratification for any treaty that binds GUN to economic or military support of another Alliance/Nation when they are at war. The SC shall be responsible for maintaining the communications mechanisms for GUN. The SC shall keep the GA informed of all matters of importance to the Alliance. The SC shall be responsible for public statements, to be made on the CyberNations Forums. The SC shall manage GUN policies for IRC communications.

The SC has the right to revoke the membership of any member of the alliance if it is found that they acted against this Constitution or in violation of policies set forth by the SC.

The SC shall act as the Judiciary body of the alliance and all disputes between members of this alliance or between members of this alliance and another nation not in the alliance shall be brought forth to the SC. The SC shall review all conflicts in which the MoFA has not been able to reach a resolution with a foreign alliance. The SC shall rule on the action to be taken after careful consideration of the impacts of those actions. Those actions may include the use of military force.

The SC is responsible for authorizing the use of Nuclear Weapons by the MoD. Authorization for the use of Nuclear Weapons may only be made in response to an attack upon a GUN member with a Nuclear Weapon.

Elections

Elections for all members of the SC and HC shall be conducted at the beginning of each of the months of January, April, July, and October. Elections shall be comprised of a self nomination process, a period of question and answer and a General Assembly vote to fill each position. The Security Council positions will be contested first, and once the election for those positions are complete, the self nomination process for the HC shall begin.

All candidates for Security Council positions must have previously held and completed a full term in GUN government as either a Minister or a Deputy Minister. Additionally, SC candidates must have a minimum of 2 months cumulative service within GUN and three (3) months of experience with CyberNations.

All candidates for positions within the HC must have a minimum of two (2) months experience with CyberNations.

Temporary Officials and Emergency Elections

In the event that a member of the SC or HC is unwilling or unable to fulfill their responsibilities, they will be temporarily replaced by one of their Deputies or, if no Deputy is available, by a member of the General Assembly. This temporary replacement will be selected (from the Deputies or GA) by the HC by a 2/3rds vote. Should a 2/3rds decision not be attainable by the HC, the SC shall select the appointment from the group of candidates that are tied with the greatest number of votes from the HC.

If a replacement is selected with more than one (1) month left in the original official's term, then emergency elections shall be conducted for the remainder of the term of that official. These elections will include the self nomination, question and answer and voting described for the normal election process, but it will only entail electing an official to the vacant office(s). If less than one (1) month remains in the original official's term, then the replacement will act in that official's capacity until the next scheduled election.

Checks and Balances

The SC shall monitor the HC's execution of the policies handed down and the activity of the HC officials. Any member of the SC may move for a vote of No Confidence in any member of the HC. Upon a 2/3rds vote for No Confidence in the HC official, that official is suspended from their position with a Temporary Official put in their place. The remaining members of the HC then vote to permanently remove the suspended official from their position. A 2/3rds vote of the remaining HC is required to remove the official. Should that vote not result in removal, the official shall return to office.

The HC shall monitor the policies set forth by the SC and the activities of the SC. Any member of the HC may move for a vote of No Confidence in any member of the SC. Upon a 2/3rds vote for No confidence in the SC Official, that official is suspended from their position with a Temporary Official put in their place. The remaining two members of the SC then vote to permanently remove the suspended official from their position. A unanimous vote to remove the official will result in Emergency Elections. Should the vote result in a consensus to not remove the official, that official is returned to office. If consensus between the remaining two members can not be achieved, then the vote is put before the GA with a 2/3rds consensus required of a 1/3rd quorum to remove the SC official from office.

Any member of the GA, at any time, may move for a vote of No Confidence in any member of the SC or HC. Such a request must get a seconding from at least one (1) member of either the SC or HC. Upon seconding, the official(s) in question are replaced with Temporary Official(s) and a GA vote is held to remove the named officials from office. A 2/3rds consensus is required of a 1/3rd quorum to remove the official from office permanently.

Admittance into GUN

Nations wishing to join GUN can become Signatories by filing an application on the GUN forums. The application will be reviewed by GUN and a background check will be performed. Acceptance of the application does not constitute full membership in GUN. Signatories may be allowed to join the GA immediately, based on their experience. Others may be required to first complete the GUN University program, during which they will be a part of the GUN University Student Body.

War

GUN is a non-aggressive alliance and seeks peace, to all extents prudent. No GUN member may make a Declaration of War or launch a Spy Operation without authorization from the Ministry of Defense. The MoD shall not direct any GUN nation to engage in war or spy operations without first receiving acknowledgement from the Foreign Affairs Ministry that a diplomatic solution is not viable or from the Security Council indicating a need for the use of force.

GUN will not use Nuclear Weapons as a first strike option. Nuclear Weapons are only a viable option for use in the event that a GUN nation was attacked with a Nuclear Weapon. Only the SC can authorize the use of Nuclear Weapons and only the Ministry of Defense may designate Nuclear targets.
