[font="Palatino Linotype"][size="6"]The Constitution of Cascadia[/size][/font]
[b][size="3"]
Preamble[/size][/b]
We, the people of this region in conjuction with the Second Distopyan Republic establish this Constitution for the Third Distopyan Republic of Cascadia. We hereby promote the protection of our people, the defense against our enemies, and the ensuring of domestic tranquility.

[b][size="3"]Article 1: The Executive Branch[/size][/b]
[b]Section 1: The Legislature[/b]
All law-making powers will be vested in both a Parliament and the President. The Parliament will consist of a House of the Youth, a House of the Workers, and a House of the Corporations.

[b]Section 2: The House of Youth[/b]
The House of Representatives will be composed of members chosen every year by the people of each province. The electors in each state shall have the requisites for the largest branch of the Parliament.

No person shall be a representative who is not at least the age of 18 and over the age of 28. The elector must be a citizen of his province, and must have been born in Cascadia.

The number of members in the Youth House shall not exceed two per province and one per Major Metropolitan area.

When in the event of a vacancy, an emergency election shall be held to fill the vacancy.

The House shall choose their Speaker and have power of Impeachment, along with the President.

[b]Section 3: The House of Workers[/b]
The House of Representatives will be composed of members chosen every year by the people of each province. The electors in each state shall have the requisites for the largest branch of the Parliament.

No person shall be a representative who is not at least the age of 21 and over the age of 45. The elector must be a citizen of his province, and must have been born in Cascadia.

The number of members in the Worker House shall not exceed two per province and one per Major Metropolitan area.

When in the event of a vacancy, an emergency election shall be held to fill the vacancy.

The House shall choose their Speaker and have power of Impeachment, along with the President.

[b]Section 4: The House of Corporations[/b]
The House of Representatives will be composed of members chosen every year by the people of each province. The electors in each state shall have the requisites for the largest branch of the Parliament.

No person shall be a representative who is not at least the age of 30 and over the age of 70. The elector must be a citizen of his province, and must have been born in Cascadia.

The number of members in the Corporate House shall not exceed one per major corporation in the Nation, elected by a board of shareholders and directors.

When in the event of a vacancy, an emergency election shall be held to fill the vacancy.

The House shall choose their Speaker and have power of Impeachment, along with the President.

[b]Section 5: Elections and Meetings[/b]
The Parliament shall assemble at least once in every year on the first of January.

[b]Section 6: Membership, Rules, Journals, Adjournment[/b]
Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business; but a smaller number may adjourn from day to day, and may be authorized to compel the Attendance of absent Members, in such Manner, and under such Penalties as each House may provide.

Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behavior, and, with the Concurrence of two-thirds, expel a Member.

Each House shall keep a Journal of its Proceedings, and from time to time publish the same, excepting such Parts as may in their Judgment require Secrecy; and the Yeas and Nays of the Members of either House on any question shall, at the Desire of one fifth of those Present, be entered on the Journal.

Neither House, during the Session of Parliament, shall, without the Consent of the other, adjourn for more than three days, nor to any other Place than that in which the two Houses shall be sitting.

[b]Section 7: Compensation[/b]
The Houses shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.

No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States which shall have been created, or the Emoluments whereof shall have been increased during such time. No Person holding any Office under the Republic, shall be a Member of either House during his Continuance in Office.

[b]Section 8: Revenue Bills, Legislative Process, Presidential Veto[/b]
All bills for raising Revenue shall originate from the President's desk, unless proposed by a petition.

Every Bill, which shall have passed each House, shall be presented to the President of the Republic before it becomes law. If he approves he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration all houses agree to pass the Bill, it shall become a Law. But in all such Cases the Votes of both Houses shall be determined by Yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively.

[b]Section 9: Powers of Parliament[/b]
The Parliament shall have power to lay and collect Taxes, Duties, Imposts and Excises, to pay the debts for the defense and Welfare of the Republic; but all such shall be uniform through the Republic;
To borrow money on the Republic's credit;
To regulate commerce with foreign nations;
To establish a currency and value amongst the nations;
To establish rule of naturalization;
To constitute Tribunals inferior to the Courts;

[b]Section 10: Limits on Parliament[/b]
The privilege of the writ of Habeas Corpus shall not be suspended unless bypassed by the President or Head of Military Staff.

No Bill of Attainder or ex post facto Law shall be passed.

No tax shall be laid on articles exported.

Any member of the houses is limited to not more than two terms.


[size="3"][b]Article 2: The Executive Branch[/b][/size]
[b]Section 1: The President[/b]
The executive power shall be vested in a President of the Republic of Cascadia. He shall hold his office during the term of four years and be elected as follows:

Each party shall present the most qualified candidate they have, and over the course of no more than a year before the election, may campaign for public election.

No person except a citizen of the Republic of Cascadia, born and raised, shall be eligible to the Office. Neither shall any person be eligible who has not reached the age of 18, and have lived in the Republic their entire lives.

In case of the removal of the President, his death, resignation, or inability to discharge the powers, the duty shall rest on a triumvirate of the three Speakers of the houses until a new President can be elected.

Before execution of office, he shall take the following vow:
"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the Republic of Cascadia, and will to the best of my Ability, preserve, protect and defend the Constitution and People of the Republic of Cascadia."

[b]Section 2: Civilian Power over Military, Cabinet, Pardon Power, Appointments[/b]
The President shall appoint a Commander in Chief of the Armed Forces, which when called into service will appoint a Staff to lead each branch of the Military.

He shall have power to make treaties, appoint a Minister of Foreign Affairs to do the same and to hire ambassadors. He shall have power to appoint a Cabinet of his choosing.


[b][size="3"]Article 3: The Judicial Branch[/size][/b]
[b]Section 1: Judicial Powers[/b]
The Judicial Power of the Republic shall be vested in a Supreme Court, and in such inferior courts as the Parliament and President may from time to time ordain and establish. The judges shall hold their offices during good behavior and shall receive a compensation during their stay in Office.

[b]Section 2: Trial by Jury[/b]
In case of ambassadors, public officials, and where a government office will be a party, the Supreme Court shall have original jurisdiction. In all other cases, the Supreme court will have Appellate Jurisdiction.

The trial of all crimes shall be by a tribunal of no more than 9 judges, and it shall always be an odd number.

[b]Section 3: Treason[/b]
Treasons against the Republic shall consist of levying War, in adhering to its enemies, or giving them aid and comfort. No person shall be convicted unless by two witnesses in their right mind or a confession.

The President declares the punishment of Treason.


[size="3"][b]Article 4: Amendments[/b][/size]
Only the President has power to make a Constitutional Amendment.

[size="3"][b]Article 5: Freedoms of the People[/b][/size]
No law or decision shall be made that;
Respects the establishment of a religion or prohibits free speech, press or petition;
Infringes on the right of the people to bear and keep weapons freely for the defense of themselves and for sport;
Forces a government soldier or police to be quartered in a house without the consent of the owner;
Violates the right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures unless a valid warrant is provided;
Punishes a citizen for a victimless crime or forces the liability of others onto a citizen;
Forces a person to answer for a crime unless on presentment or indictment of a Grand Jury;
Removes the right to a speedy and public trial by a Jury;
Inflicts a cruel or unusual punishment on any person.


[size="3"][b]Article 6: The Distopyan Rights[/b][/size]
1. All men and women are created equal, period.
2. No man is responsible for another's wellbeing unless they bring it upon themselves.
3. The more dependant a man is on the government, the more the government will call upon him.
4. Conversely, the more responsible for himself a man is, the less the government should interfere with him.
5. The people have a right to riot and complain directly to the government.


[size="3"][b]Article 7: Ratification[/b][/size]
Done in Convention by the Distopyans and the Leader of the Cascadian Liberation Army on the Twenty Sixth day of March in the year Two Thousand and Ten. It witness whereof we have hereunto subscribed our names.
