Constitution

of the

People's Democratic Haruhiist Republic of Karafuto

The Proletarian Class of Karafuto, desirous of establishing a Government of the People based on the values of respect for human dignity and the civil rights of freedom, equality, the rule of law, justice, and peaceful coexistence with our fellow men and with our environment; to promote the general welfare of the people of the people; provide for the defense of Karafuto as a sovereign state and entity within International Law; conscious that the will of the people is the basis for the authority of all Government; committed to sharing with all people a peaceful future based on common values; recognizing the inherent dignity of all members of the community of equals and of humankind; pledging that the people shall enjoy the protection of the law of Karafuto against violations of their inalienable rights and fundamental freedoms by the Government thereof; believing that common recognition of these rights and freedoms is of the greatest importance for the realization of this pledge; recognizing the supremacy of Haruhi Suzumiya as the Goddess of the Universe and desiring to establish a government to serve her as she serves the people; and in the hope that the Government of the SST embody the above listed values in its development of a peaceful society, do hereby proclaim the People's Democratic Haruhiist Republic of Karafuto as a free and independent state encompassing all curtent Shinsei Shikkoku Teikoku territory.

第二条

The Government of the Republic, as described herein, draws its authority from the people, as a direct and infallible representation of the Will of the Goddess. Any law which is enacted by the Government which violates the writings and teachings of the Goddess, which fails to achieve the support of the populace, or which violates any part of this document shall be shall be invalid within the jurisdiction of the Republic to the extent of such conflict.

The male pronoun is used throughout this document exclusively as a gender-neutral pronoun and except where otherwise indicated all of the provisions of this document apply equally to all persons regardless of gender. The female pronoun is used throughout this document only in relation to the Goddess and qualified representatives acting on her behalf, as described herein.

第四条

The rulership of the Republic is vested in the Goddess, Haruhi Suzumiya, who shall assume the nontransferable title of Eternal President of the Republic.

When it is impossible or impracticable for the Goddess to maintain order and rule over the Republic, she shall be represented by a popularly-elected Governor General who shall serve with the approval of the Goddess. Elections for the position of Governor General shall be held once every fifty-four lunar months. The Governor General shall, when legally representing the Goddess, assume all the powers and responsibilities granted to the Eternal President of the Republic herein.

Title to the territory of the Republic resides in its people.

第五条

Popular governance of the Republic shall be facilitated through the People's Assembly, which shall be the sole legislative body of the Republic. The People's Assembly shall consist of one member for every one hundred thousand citizens or portion thereof, elected by the people once every fifty-four lunar months.

Motions presented to the People's Assembly shall be read by all members who cast a vote within the People's Assembly. No vote before the People's Assembly, save motions pertaining to war or diplomacy, shall have a voting period of less than fourteen days nor more than one hundred eighty days. During the voting period of any motion, any vote cast may be changed at any time by the member who cast it. The voting period may be ended at any point between the fourteenth and one hundred eightieth day by a qualified majority of the members of the People's Assembly.

Motions pertaining to war or diplomacy shall have a voting period of no less than fourteen days and no more than thirty-one days.

The Eternal President of the Republic shall represent the Republic among States, declare war, and conclude peace in the name of the Republic and its people, enter into alliances and other conventions with foreign States, accredit ambassadors, and receive them. All of these actions require the approval of the People's Assembly, except in case of an attack upon the territory of the Republic or its coasts, in which case the President may declare war on the offending State without requiring the approval of the People's Assembly.

The President shall have the right to convene the People's Assembly, and to open, adjourn, preside over, and close meetings of such.

To the President shall belong the right to prepare and publish the laws of the Republic, and to ratify such by her signature, following their approval by the People's Assembly.

The President shall be the Head of State and Head of Government of the Republic.

Any group of six or more members of the People's Assembly may jointly propose the recall of the Governor General by submitting to the People's Assembly a motion to replace the sitting Governor General with another member of the People's Assembly. Such a motion must include the name of the proposed member to replace the Governor General, and said member must also be a signatory to the motion.

Such a motion must be accepted by a qualified majority of the People's Assembly as well as the Eternal President of the Republic to pass.

Should such a motion pass, it must be ratified by a referendum of the people within six lunar months of its taking effect.

The status of citizen of the People's Democratic Haruhiist Republic of Karafuto shall be acquired, retained, and lost at the will of the Eternal President of the Republic.All citizens of the Republic shall enjoy civil and political rights as set forth herein.

第九条

Every citizen of the Republic in the territory of a foreign country in which the Republic is represented by diplomatic or consular authorities shall be equally entitled to protection by those authorities to the extent that such protection is available to any citizen of the Republic.

第十条

The judicial power of the Government of the Republic shall be vested in the Eternal President of the Republic. The judicial power of the President shall extend to all cases, in law and equity, arising under the legal instruments of the Republic, namely this document; the laws, regulations, and orders of the Government of the Republic; and international agreements made, or which shall be made, under their authority.

Despite Article 4, the Governor General shall never assume the judicial power of the President. When it is impossible or impracticable for the Goddess to practice her judicial power, that power shall be granted to the Most Holy Office of the Inquisition, which shall be established under the leadership of a five-member Council of the Inquisition. Said Council shall be elected by the People's Assembly with the approval of the President. The Council, and any of the appointments it may make, is recallable at any time by the President or by a motion signed by six or more members of the People's Assembly.

Such a motion must be accepted by a popular majority of the People's Assembly to pass.

The Eternal President of the Republic may establish jurisdiction, including the carriage of sentences into execution, over any offense against the legal instruments of the Republic, or against the founding documents, declarations, or other acts of an alliance of States or nations or other international body to which the Republic has been admitted, which is committed in the territory, territorial waters, or the seabed, subsoil, water column, insular shelves, airspace over land and water, or any part of the exclusive economic zone of the Republic as delimited by the legal instruments of the Republic or by international agreement; committed on board a vessel or aircraft flying the flag of the Republic, registered under the laws of the Republic, or operated by the Government at the time the offense is committed; committed by or against a citizen or military subject of the Republic; committed by or against a stateless person under the legal guardianship of the President or a citizen or military subject of the Republic, in accordance with the laws of the Republic, at the time the offense is committed; committed against a State or Government facility of the Republic abroad, including an embassy, high commission, or other diplomatic or consular premises of the Republic; or committed in an attempt to compel the President to commit or abstain from committing any act or omission within the scope of her powers, authorities, or functions as established by law.

The President shall have original jurisdiction, as well as appellate jurisdiction, both as to law and fact, in all cases.

The President may request that a court or tribunal or other organ of a foreign State or alliance of States or nations that is entitled to exercise judicial functions give advisory opinions on legal questions concerning any matters brought before the President, in her judicial capacities, whenever she considers it expedient to confer consultative competence upon that court or tribunal or other organ.

An advisory opinion so given shall not be legally binding within the jurisdiction of the Government of the Republic without the consent of the President.

The power to administer the finances of the Republic shall be exercised according to the determination of the People's Assembly, which shall vote on and approve the budget of the Government of the Republic annually by a qualified majority. No new taxes shall be imposed or existing ones modified except by law or under such conditions as the law may prescribe. No money shall be expended except as authorized by the annual budget.

There shall be established a Treasury of the People's Democratic Haruhiist Republic of Karafuto, which shall, in accordance with policies and procedures established by the Treasury itself or by law, carry out its responsibilities as set forth herein in order to support the socialist economic policies of the Republic and to promote the economic and financial welfare of the citizens of the Republic.

第十五条

The Treasury shall establish, regulate, supervise, and actively promote a safe, sound, and efficient financial system of the Republic, based off of the policies of economic socialism. At the request of the People's Assembly, the Treasury shall provide policy advice on the design and development of the financial system of the Republic.

第十六条

The Treasury shall manage the foreign exchange, commodity, and other financial-instrument reserves of the Republic. The Treasury shall be responsible for carrying out the monetary policy of the Republic using any available instruments and in accordance with the direction of the People's Assembly.

第十七条

The Treasury shall issue to participants in the financial system of the Republic a supply of promissory bills or notes or other media of exchange (“currency”), payable on demand, adequate to provide liquidity to all eligible participants. The Treasury shall be responsible for the design, distribution, and replacement of this currency.

The official currency of the Republic is the Monetary Unit of Karafuto, which may be represented domestically by the symbol “円” and the word “yen”, and internationally by the symbol “¥” and the phrase “Karafutese yen”.

The Monetary Unit of Karafuto shall be subdivided into the “sen”, further represented by the symbol “銭”, with a value of one hundredth of a yen; and the “rin”, further represented by the symbol “厘”, with a value of one tenth of a sen.

All currency shall be issued in denominations of yen, sen, and rin.

When appropriate and as authorized to do so by the People's Assembly, representatives of the Treasury shall participate in international financial activities and engage in financial business operations in behalf of the Republic.

第十九条

The People's Assembly shall hear testimony from the people regarding the financial and labor conditions of the proletariat whenever the people deem it necessary, and shall attempt to improve the overall financial and labor conditions of the people to the best of its ability and to the benefit of all people and the Republic.

第二十条

There shall be established when necessary an Armed Forces of the People's Democratic Haruhiist Republic ofKarafuto which shall consist of such principal and subsidiary branches as may be required to carry out their responsibilities as set forth herein and such other functions as are prescribed by the Eternal President of the Republic and the People's Assembly.

Military subjects of the Republic shall not enjoy the civil and political rights of citizens of the Republic as enumerated in this document but in all other respects their treatment under the law of the Republic should be consistent, at least insofar as is practicable, with the treatment of citizens.

第二十一条

The Government of the Republic, by authorization of the Eternal President of the Republic with the approval of the People's Assembly, shall equip and maintain the Armed Forces as may be considered adequate and effective for the purposes of defending the people or territory of the Republic from external aggression, treachery, or other threats to their security or welfare; maintaining the territorial integrity of the Republic and securing its borders and other frontiers from violation; meeting the military obligations and commitments of the Republic in accordance with international agreements; and performing such other functions as are prescribed by the President with the approval of the People's Assembly.

第二十二条

Military command of the Armed Forces is vested in the Eternal President of the Republic. This shall include the power to determine the operational use of the Armed Forces and the power to appoint officers within all principal and subsidiary branches of the Armed Forces established in accordance with the provisions of this document.

第二十三条

The offense of Treason against the People's Democratic Haruhiist Republic of Karafuto shall consist of any of the following acts: attempting or conspiring to kill the Eternal President of the Republic or the Governor General; perpetrating a non-consensual punishable sexual offense, as previously established by law, against the President or the Governor General; successfully or unsuccessfully attempting or conspiring with any other person to overthrow the Government of the Republic or to overturn the socialist economy of the Republic; acting to help a foreign State or Government overthrow, make war against, or seriously injure the people, territory, economy, or Government of the Republic; levying war against the Republic, or adhering to its enemies in time of war, giving them aid and comfort; or, in time of war, with the intent to help the enemies of the Republic, committing or attempting or conspiring with any other person to commit any act which is designed or likely to give assistance to the military operations of the enemies of the Republic or to impede such operations of the Armed Forces of the Republic.

The State Flag and Ensign and War Flag of the People's Democratic Haruhiist Republic of Karafuto shall be a standard consisting of a red field emblazoned with the Arms of the People's Democratic Haruhiist Republic of Karafuto, as described herein, of a fixed proportion of 1:2.[/justify]

The Arms of the People's Democratic Haruhiist Republic of Karafuto shall consist of a stylized roundel in the colors chartreuse, indigo, magenta, electric blue, and Dartmouth green, and bearing the phrase “SOS団”.

第二十六条

The National Anthem of the People's Democratic Haruhiist Republic of Karafuto shall be Hare Hare Yukai.

第二十七条

The Motto of the People's Democratic Haruhiist Republic of Karafuto shall be “冒険でしょでしょ?” (“It's an Adventure, right? Right?”).

第二十八条

Every person is equally possessed of the rights and freedoms set forth herein and is entitled to equal protection against discrimination on behalf of the Government of the Republic in violation of these rights.

第二十九条

The enjoyment of the rights and freedoms set forth herein shall be secured for every person without discrimination on any ground. In particular, discrimination based on gender; race; color; ethnic, national, or social origin; association with a national minority; genetic features; size or stature; language; religion or belief; political or other opinion; property; birth; disability; age; sexual orientation; or other such status shall be prohibited. Furthermore, no distinction shall be made on the basis of the political, jurisdictional, or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing, or under any other limitation of sovereignty.

第三十条

Every person whose rights and freedoms guaranteed herein are violated by the Government of the Republic has the right to an effective remedy at a fair and public hearing before the Eternal President of the Republic.

第三十一条

Every person has the right of physical access to a standard of living adequate at minimum for the survival, health, and subsistence of a typical individual. In particular, physical access to safe and effective shelter, including adequate warmth; and regular and sufficient supplies of safe drinking water and nutritious, unadulterated food shall be secured for all persons by the Government of the Republic.

第三十二条

It shall be prohibited for the Government of the Republic to impose any law which limits the right of any person to end his own life at will, provided that the person has been judged competent by the Eternal President of the Republic or an organ of the Government of the Republic authorized by the President to make such determinations. Furthermore, it shall be prohibited for the Government of the Republic to impose any law which makes less eligible the will of such a person by restricting his ability to seek or to obtain through voluntary request assistance to end his own life.

第三十三条

No person shall be held against his will by the Government of the Republic in slavery or servitude. No person shall be required against his will by the Government of the Republic to perform forced or compulsory labor, with the exception of work required to be done in complete or partial fulfillment of a sentence imposed by the Eternal President of the Republic as penalty for an offense against the laws of the Republic committed by the person; and of any service extracted in time of Proclaimed Emergency or other calamity threatening the life or well-being of the Republic or its people.

Every person has the right to have his physical integrity respected by the Government of the Republic. Insofar as is practicable, the free and informed consent of a person must be sought before any individual medical or biological treatment measure is undertaken on the person by the institutions and bodies of the Government of the Republic.

第三十五条

No person shall be subjected by the Government of the Republic to torture or to inhuman or degrading treatment or punishment.

第三十六条

The right to seek and enjoy asylum from persecution shall be guaranteed to all persons by the Government of the Republic with due respect for the provisions of international agreements to which the Republic is a party. This right may not be invoked in the case of prosecutions genuinely arising from acts or omissions contrary to the purposes and principles of alliances of States or nations or other international bodies to which the Republic has been admitted.

The Government of the Republic shall be prohibited from recognizing any act or omission committed by a person while outside the territory of the Republic as an extraditable offense unless the act or omission runs contrary to the founding documents, declarations, or other acts of an alliance of States or nations or other international body to which the Republic has been admitted.

第三十八条

Every person has the right to freedom of expression. This right shall include freedom to transmit information and ideas without interference of any kind by the Government of the Republic and regardless of frontiers.

第三十九条

Every person has the right to freedom of peaceful and unarmed assembly and to freedom of association with others. No restrictions shall be placed by the Government of the Republic on the exercise of these rights other than such as are necessary in the interests of national security or public safety, for the prevention of disorder or crime, or for the protection of health.

第四十条

Every person who is arrested or detained by the Government of the Republic has the right to be informed promptly, in one of the natural languages which he understands, of the reasons for his arrest or detention and of any charge levelled against him by the Government. Every person so arrested or detained has the right to take proceedings by which the lawfulness of his arrest or detention shall be decided speedily by the Eternal President of the Republic and to have his release ordered if the arrest or detention is not lawful.

第四十一条

In the determination of his rights and duties and of any charge leveled against him by the Government of the Republic, every person is entitled in full equality and within a reasonable time to a fair and public hearing by the Eternal President of the Republic. Judgments of the President in this capacity shall be pronounced publicly in all cases but public access to the physical premises of some or all portions of the hearing may be limited to the extent strictly necessary, in the estimation of the President in the interests of public order, national security, or justice.

第四十二条

Every person charged by the Government of the Republic with an offense against the law of the Republic and found to be competent to stand trial for the offense by the Eternal President of the Republic is entitled to the following minimum rights to be exercised according to rules of procedure previously established by law: to be informed promptly, in one of the natural languages which he understands and in detail, of the nature and cause of the accusation against him; to have adequate time and facilities for the preparation of his defense; to defend himself in person or through legal assistance of his own choosing and arrangement; to examine or have examined by a legal assistant or legal assistants of his own choosing and arrangement any witness against him; to receive the assistance of the Government of the Republic in obtaining the attendance of witnesses on his behalf insofar as it is within its authority or ability to provide such assistance; to examine or have examined by a legal assistant or legal assistants of his own choosing and arrangement any witness on his behalf under the same conditions as any witness against him; and to have the free assistance of a competent interpreter provided for him, by the Government of the Republic if need be, if he cannot understand the language used in his proceedings or if he cannot speak the language used in his proceedings.

第四十三条

No person shall be held guilty by the Government of the Republic of an offense against the law of the Republic on account of any act or omission which did not constitute an offense under the law of the Republic at the time it was committed; nor shall a heavier penalty be imposed than that which was applicable at the time the act or omission was committed. If, subsequent to the commission of an offense, the law of the Republic requires a lighter penalty be imposed for the same act or omission than that which was applicable at the time the act or omission was committed, it is the lighter penalty that shall be applicable. Likewise if, subsequent to the commission of an offense, the law of the Republic stops recognizing an individual act or omission as constituting an offense, no person shall be held guilty by the Government of the Republic of an offense on account of any such act or omission which was committed prior to the stoppage in recognition.

Every person has the right to have his affairs handled impartially, fairly, and within a reasonable time by the institutions and bodies of the Government of the Republic. This includes the right of every person to be heard by the Eternal President of the Republic before any individual measure which would affect the person adversely is taken; and the right of every person to communicate with, and receive available resources from, any institution or body of the Government of the Republic.

第四十五条

Upon receipt of a written request from any natural person or member or organ of an alliance of States or nations or other international body to which the Republic has been admitted, the Government of the Republic shall furnish an explanation of the manner in which the law of the Republic ensures the effective implementation of any of the provisions of this document.

第四十六条

In time of Proclaimed Emergency or other calamity threatening the life or well-being of the Republic or its people the Eternal President of the Republic may take measures derogating from her duties or the duties of the Government under this document to the extent strictly required by the exigencies of the situation. Whenever the President avails herself of this option of derogation she shall keep the people of the Republic and the appropriate authorities of all alliances of States or nations and other international bodies to which the Republic has been admitted fully informed of the measures which she has taken and the reasons therefore. She shall also inform the people of the Republic and the appropriate authorities of all alliances of States or nations and other international bodies to which the Republic has been admitted when such measures have ceased to operate and the provisions of this document are again being fully executed.

The People's Assembly, by majority vote, may terminate the ability of the President to avail herself of this option of derogation and restore the provisions of this document in full at any time when the President has availed herself of this option of derogation.

Nothing in this document shall be interpreted as restricting or adversely affecting human rights and fundamental freedoms as recognized, in their respective fields of application, by the law of the Republic and International Law and by international agreements to which the Republic is a party.

第四十八条

Nothing in this document shall be interpreted as implying any right of the Government of the Republic to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms recognized in this document or at their limitation to a greater extent than is provided for herein.

第四十九条

The restrictions permitted under this document to the rights and freedoms set forth herein shall not be applied by the Government of the Republic for any other purpose than those for which they have been prescribed by this document.

第五十条

Motions proposed to the People's Assembly that propose amendment to this document shall require a qualified majority and the approval of the Eternal President of the Republic to be passed, and shall not be effected during a time of Proclaimed Emergency or at any time when the President has exceeded her normal mandate to protect the interests of the Republic as provided for under this document.

第五十一条

This document and the laws of the Republic which shall be made in pursuance thereof shall be the Supreme Law of the territory of the People's Democratic Haruhiist Republic of Karafuto. Should any part of the Supreme Law of the Republic be found to be contradictory to this document, or the terms of any international agreement to which the Republic is a party, it shall be rendered null and void for the duration of the effective implementation of such laws or terms.
