I know the some of you who saw this once are thinking, "What the hell? I thought he did this once." If you care, I did, but school caught up to me and The Huang Dynasty stagnated. And then, following an attack by a nuclear-armed rogue named kwinin, the Huang Dynasty collapsed, and the two members present left. Now, after some time helping out my old comrades in the German Empire, I leave again to create THD once more. Everything is ready this time, unlike the first, and through planning we will grow.

We are protected by TOOL. I formally apologise to TPF, seeing as to how our protectorate agreement did not work out since THD quietly ceased to exist.

i. Background

Crossbowman, a long-time resident of the German Empire who resided in Königsberg, decided to leave the alliance after much deliberation to found a new alliance of his own, which he decided to call the Huang Dynasty. He then went into self-imposed isolation to work and think before returning to the political sphere of Planet Bob, hoping that the new alliance would stand firm. Unfortunately, it collapsed due to an attack, and Crossbowman returned to the German Empire before moving out to recreate it with plans for its future.

ii. Preamble

For the purpose of creating a new cultural alliance for CyberNations players who are of the Chinese culture, are interested in Chinese culture, or happen to appreciate Chinese culture at all, the Huang Dynasty will be created.

I. Article One

"Entry and Expulsion"

I.1. Verse One - Admittance

For admittance to the Huang Dynasty, one must follow the set of procedures detailed below. In addition, after admittance to the Huang Dynasty, one may not join any other alliance unless one resigns publicly from the Huang Dyansty first.

- Prospective members must register on the Huang Dynasty forums and post an application,

- Prospective members must set their Alliance Affiliation [AA] to "The Huang Dynasty,"

- Prospective members must have their applications approved before allowed to formally join the Huang Dynasty,

- Prospective members must join the White Sphere unless a specific reason is given.

I.2. Verse Two - Resignation

Resignation may occur at any time should the person who is resigning wish to to do so. However, the resigned must first post a topic in the Great Hall detailing why they wish to leave, and after this is done the resigned must remove "The Huang Dynasty" from his AA. Should this requirement not be followed, the person in question will never be allowed to join the Huang Dynasty again.

I.3. Verse Three - Expulsion

A citizen of the Huang Dynasty make be expelled at any time at either the discretion of the Emperor or with a two-thirds majority vote in the Public Council for any reason within the normal bounds of logic, including but not limited to high treason [such as attempted regicide], espionage [such as intelligence gathering], grievous insults to others [such as the extreme usage of profanity], and general misconduct [such as desertion from the military].

II. Article Two

"Imperial Chinese Government"

II.1. Verse One - The Chinese Emperor

The Emperor of the Huang Dynasty is the head of state and the head of government of the Huang Dynasty. He controls the entirety of the Imperial Chinese Government and may not be removed from power unless it is by his own free will. He has the right to change anything regarding the Constitution of the Huang Dynasty provided that he specifies what he changed and publicly announces any change, and may veto any piece of legislation passed by the Public Council provided that a secondary vote held to overrule the veto does not pass by a two-thirds vote.

II.2. Verse Two - The Emperor's Council

The Emperor's Council, herein referred to as the EmpCouncil, is appointed by the Emperor, and serves as the ministries under him. The Emperor may appoint however many Councilmen to the EmpCouncil as he wishes, although the EmpCouncil does not possess any real internal power. Outside of the Huang Dynasty, the EmpCouncil will represent the Huang Dynasty should the Emperor not be present. All documents and files processed by the Emperor's Council must be approved by the Emperor before they can be considered legitimate. In essence, the EmpCouncil aids the Emperor in performing important tasks in the Huang Dynasty. Every minister may appoint a number of deputies to aid him in his tasks, and these deputies are also considered part of the Emperor's Council.

  • II.2.1. Section One - Minister of Internal Affairs
    The Minister of Internal Affairs oversees domestic activity within the Huang Dynasty, and reports on any notable findings to the Emperor. He is the most important member of the EmpCouncil, as he has the responsibility of keeping the Dynasty organised. Disputes are brought to the MoIA for solutions, and if a dispute cannot be solved by the MoIA he may bring it to the Emperor.
    II.2.2. Section Two - Minister of Finance
    The Minister of Finance oversees the economy and trading sector of the Huang Dynasty. He is responsible for organising tech deals and trade circles within the Huang Dynasty. With collaboration with the Minister of Foreign Affairs, the MoF can also organise inter-alliance tech deals and trade circles.
    II.2.3. Section Three - Minister of Foreign Affairs
    The Minister of Foreign Affairs oversees foreign activity and reports anything notable to the Emperor. He is responsible for appointing ambassadors and creating embassies in other alliances and creating foreign relations reports for the Emperor.
    II.2.4. Section Four - Minister of War
    The Minister of War oversees all military activity and military aid. The MoW organises the Huang Dynasty during times of peace and war and rallies the troops when a war does come.

II.3. Verse Three - The Public Council

The Public Council, herein referred to as the PubCouncil, is elected directly by the people through anonymous vote held once every month. The PubCouncil holds more legislative power and ability than the Emperor's Council, as it not appointed by the Emperor and does not need direct approval of the Emperor to perform its most of its duties and tasks. The PubCouncil serves as the vox populi, and may push for bills and legislation to be passed in the Emperor's Council. By itself, the PubCouncil may pass legislation with a majority vote, and legislation must receive approval from the Emperor. Otherwise, the PubCouncil may vote to remove members of the Emperor's Council, declare pieces of legislation to be harmful to the people, or perform plebiscites, et cetera without intervention by the Emperor except a single peremptory veto.

II.4. Verse Four - The Judiciary

The Judiciary is selected by the Emperor and approved by the Public Councilto manage all legal tasks, which consist primarily of solving legal disputes and conflicts marked by the Minister of Internal Affairs. All decisions made by the Judiciary pass through the Emperor, who then makes sure that the decisions made do not involve the explusion of a member or an alteration of the Constitution; all other decisions made by the Judiciary are final. Other decisions that involve explusion of a member of the alteration of the Constitution must be approved or denied by the People's Council or the Emperor; an approval in the People's Council can be overridden by the Emperor unless voted on again. Members of the Judiciary may be removed by the Public Council with a two-thirds majority vote or the Emperor.

II.5. Verse Five - Committees

Committees may be set up by any citizens of the Huang Dynasty at any time and for any reason, though these committees must be approved by the Emperor and/or Public Council before going into effect. A committee may be shut down by the Emperor or Public Council, whichever comes first, if it is not sanctioned by the Emperor beforehand; sanctioning means that a committee is written into the Constitution as official and may then no longer be disbanded by the Public Council, though the Emperor may still choose to disband said committee if so desired.

III. Article Three

"Government Procedures"

III.1. Verse One - The Selected Officials

The Emperor of the Huang Dynasty may simply create or abolish ministries at any time, and ministries are collectively known as the Emperor's Council as specified in Article Two, Verse One. The Public Council may motion to abolish a ministry within the EmpCouncil if necessary, though this abolition must be given a reason and must not be directly opposed by the Emperor. The selected officials, bearing less power than the elected, are given lax selection procedures.

III.2. Verse Two - The Elected Officials

All elected officials are elected by an alliance-wide, monthly vote. All votes may be kept anonymous if wished, and should a tie take place between multiple officials the Emperor shall break the tie; however, this usually is unnecessary. The vote, unless postponed for any reason, takes place on the first Sunday of every month, and the terms of each official is two months. The election is staggered in such a manner so that only half of the Public Council is replaced at each election. There are five members in the Public Council, and this number may be increased or decreased by the Public Council with the approval of the Emperor. To be eligible for election to the Public Council, the member in question must not be a member of the Emperor's Council, the Judiciary, or any other body above the level of committee. A questioning period will take place for up to one week before the actual election.

III.3. Verse Three - The Special Cases

The Judiciary is an example of a special case that is not entirely selected or elected. All special cases that are a mixture of both selection and election are subject to any written legal code for that particular body; for example, the Judiciary is written to be selected by the Emperor and then approved by the Public Council. Special cases are not subject to explicit regulation by the Constitution.

III.4. Verse Four - Martial Law

Martial law may be declared by the Emperor at any time and for any reason. During a period of martial law, the Public Council, the Judiciary, and select committees are suspended from action, and the Emperor may do anything he wishes for the maximum duration of two weeks before martial law is reinstated. Reinstallation of martial law requires the meeting of all government bodies, with a simple majority vote to continue martial law. If a meeting is not possible, martial law will continue for another two weeks.

IV. Article Four

"The Iron Dragon"

IV.1. Verse One - The Chinese Military

The Military of the Huang Dynasty, herein referred to as the Imperial Army, is divided into two main groups: the Green Standard Army, which is for low-level and unassigned members, and the Army of Forbidden Banners, which is for upper-level members. The two divisions within the Imperial Army are each controlled by one General, who are in turn under the command of the General of the Imperial Army, who also serves as the Minister of War. All members of the Huang Dynasty are obligated to serve in the Imperial Army, and those who desert will be either shot or evicted from the Huang Dynasty.

IV.2. Verse Two - The Command Structure

The Imperial Army is controlled by the Minister of War, who is, during times of war, known as the General of the Impeiral Army. The Minister of War manages all aspects of the Imperial Army during times of both war and peace and answers only to the Emperor. He and his two appointed Generals serve as the High Military Command, and his Generals may appoint further Colonels to control different subdivisions of the Imperial Army. Should the Minister of War ever be incapacitated, whether by inactivity or desertion on the battlefield, the two Generals will serve as the interim Joint Military Command until such a replacement Minister of War may be found. The Emperor may at any time dismiss a member of the High Military Command.

  • IV.2.1. Section One - The Lower Command
    The Lower Command of the Imperial Army consists of any appointed Colonels, and the Lower Command may meet with the High Military Command at any time. The size of the Lower Command may vary depending on the whims of the High Military Command and the Emperor of the Huang Dynasty, who may appoint or remove Colonels as needed. Colonels command subdivisions within the Green Standard Army and the Army of Forbidden Banners.
    IV.2.2. Section Two - The Military Divisions
    Beneath the divisions between the Green Standard Army and the Army of Forbidden Banners lie the Divisions, which can be created or destroyed at the decree of either the Minister of War or the Emperor. There is no limit to how many Divisions are active at any one time in the Green Standard Army, but every Division must be commanded by a Colonel and have a maximum of five members. The Army of Forbidden Banners may only have up to eight Divisions at any one time, but the number of members within each Division is ten instead of five.

IV.3. Verse Three - Military Authorisation

The Imperial Army is allowed to use whatever is at its disposal at any time to solve military conflicts. The authorised methods include but are not limited to tactical first strikes, strategic bombing, cruise missile warfares, et cetera, with the notable exception of nuclear missiles. The High Military Command may treat deserters and the disloyal as deemed necessary with approval from the Emperor.

  • IV.3.1 Section One - Raids
    Technology raids against unaligned nations not within the red or white colour spheres are allowed for as long as the High Military Command is notified and approves of such an attack. In a tech raid, only normal ground attacks are allowed; air strikes, naval attacks, cruise missile bombings, et cetera are strictly forbidden. An unaligned nation includes those within alliances with ten members or less that are not protectorates.
    IV.3.2 Section One - Expansionism
    The Huang Dynasty reserves the right to expand its borders through peaceful integration but not military subjugation. Peaceful integration includes immigration, while military subjugation includes any form of coercion towards a foreign nation with the intent of demanding them to join the Huang Dynasty. Such military subjugation is not allowed. Tech raids fall slightly under the Expansionism category, but is allowed for as long as the targeted nation is unaligned and is not within the red and white colour spheres, as noted above.

IV.4. Verse Four - Nuclear Weapons

The Imperial Army is strictly forbidden from using nuclear weapons at any time unless personally authorised by the Emperor himself and with a simple majority in the Public Council. Nuclear first strikes are typically avoided unless absolutely necessary for the continued survival of the Huang Dynasty.

V. Article Five

"Amending the Constitution"

V.1. Verse One

At any time, the Emperor may alter the Constitution of the Huang Dynasty for as long as the entire alliance is notified. Furthermore, the Public Council and the Judiciary may motion to change the Constitution if so desired; such a change must be approved by the Emperor.
