TAHE Forums: http://z15.invisionfree.com/AustroHungaria...dex.php?act=idxCharter Imperial Charter of The Austro Hungarian Empire The Cybernations Alliance of the Austro Hungarian Empire, in order to provide for and protect its members, hereby establishes the following laws of the Austro Hungarian Alliance. These laws are essential for any thriving alliance, as they govern proper conduct, rule, and order of Cybernations Nations. Section I: Government Structure, Power, and Representation Article I: Federative Power All power is not invested into one institution, as power tends to corrupt absolutists. Therefore, the Emperor stands with his Imperial Council. This Council, made up of representatives of the alliance commoners, reserves the right to question the Emperor. However, while the Emperor does not enjoy supreme and unrestricted power, he may well make use of his “Executive Powers.†Article II: Executive Powers Defining any power not specifically decided upon by the Council as “Executive Power,†as well as any predetermined right or privilege the Emperor has, the Emperor may use the right of “Executive Power†when a grave decision is made and the Council cannot come to a conclusion with either one another and the Emperor or the Emperor and a united Council. Executive Power authorizes the reigning monarch to do as he wishes, so long as what he wishes are within best interests of the alliance. Noting, however, that the Council can argue for a position, be it international, foreign, or any other affair, and that under this alliance, everyone is entitled to his opinion, while Executive Power authorizes the Emperor to go about his will, it does not give him cause to target specific members in any form simply because of opposite views or any other reason. Article III: Representation The Council, made up of the Ministers and Officials of the alliance, reserves the authority to challenge the crown. This challenge is known as an “Appealâ€. If an official “Appeal†is made to the reigning monarch, it must be notarized by at least one-half of the Council. If it is not, it is invalid. If it is, the Appeal is “legitimized,†and goes on to the monarch. The monarch will then have a 3-day time-span to either give in to the Appeal, compromise with the Council, or refute the Appeal. If the Appeal is refuted, it then carries on to an alliance-level vote. After the polls close on the end of the 3rd day of voting, the results are revealed publicly. If the Appeal lost by a vote of majority, it is cast out. If it has won by majority vote, it is legitimate, and must be adhered to completely or to the point of the Council’s choosing. The Council, however, must remember that Appealing is an arduous process, to be reserved only for when the alliance is certainly headed in the wrong direction. Article IV: States of Emergency While this great alliance will surely not face a perilous fate, it is best to be prepared, and so the Monarch has a right to the powers under Article IV: States of Emergency. If the alliance is engulfed in deep turmoil, due to war or other disaster, if the alliance is experiencing very stubborn corruption of it’s officials and they can not be gotten rid of, or if the alliance is crumbling and there is still chance of survival, the a State of Emergency shall be declared. Within this State, the monarch reserves all the rights of the Council EXCEPT the right to Legitimate Descent, the right to meet and discuss affairs on the alliance boards, and the right to take the individual’s jobs (to elaborate: the Emperor cannot simply decide he is to take the job of Minister of Foreign Affairs). He can however, impeach any official or minister if he can clearly cite examples of the official’s insolence or failure to perform their job. In a less extreme circumstance, an official or minister can be asked to step down, or “Resignâ€, if they have performed their job not satisfactorily, or they do not have decent enough time to commit to their job. Someone can be resigned at any time. Article V: Enemies of the State and Treason If a former alliance member nation is found guilty of being a spy, knowingly aiding a spy, hacking alliance forums, or performing any treacherous activities, he may be declared a “Treasonous State†and can be destroyed as seen fit by the Emperor. Section II: Charter Reforms Article I: Amending All things said in this Charter are subject to change, as seen fit by the alliance. If a nation wishes to amend this document, they must submit an “Amendment†and declare reform is necessary. In this matter, the Emperor and Council shall not be equal for the good of the alliance. And so, if the Emperor and one-half of the Council approves of the Reform, this document is amended. If the Emperor denies approving the Amendment, then the only way to override the Emperor would be to get 100% Council approval and 75% general population approval, acquired through a several day vote. Article II: Special Reforms If the Emperor wishes to amend this document, he must get an approval of one-half of the Council. If this is not obtained, the general population must vote, and if 40% of the general population votes for the reform, this document is reformed. Section III: The Rights of the Individual Nation Article I: List of Rights The rights enjoyed by the individual nation, be he massive or small, a commoner or a Minister, include: The right to suggest appeals, reforms, etc. The right to leave this alliance at any time IF they have not committed any sort of illegal act (spying, etc.) The right to defend himself militarily The right to request a private meeting with any official of the AHE, with the PRIVACY remaining such at all times if requested by that nation The right to Legitimate Descent, as long as it remains legitimate Section IV: War Article I: If the emperor and Minister of War agree that the said nation/alliance is a threat to TAHE then TAHE enters into a state of war with the said alliance/nation.
