BCNA: Trial begins for former Chernorussian government officials

“In a short statement released today by the Buryatian Supreme People’s Court, the Chief Justice has announced that the trial of former Chernorussian government officials is set to begin as early as next week. This ruling comes after the court confirmed that the diplomatic immunity that would have been afforded to Chernorussian officials was voided in this case. The Court has not confirmed the reports that Chernorussian leader ‘Big Brother’ is in custody, but they have confirmed that several Chernorussian officials have been detained. The Court also confirmed that a team of lawyers has been appointed to defend the accused.

In other news, the body of Former Foreign Minister Onatopp arrived in Yakutsk today, and was met by a military honor guard. President Rokossovska has confirmed that Dr. Onatopp will be posthumously awarded the Order of Lenin for her service to the nation. Several hundred mourners lined the route from the airport to the Capital Building where Dr. Onatopp will remain until her funeral.

Along the route some protesters held up anti-Chernorussian banners and others burned the Chernorussian flag in protest. The government has reiterated its promise to hold those responsible for Dr. Onatopp's assassination ‘fully accountable before the law’.

When asked if the Courts would consider transferring the case to the World Congress' Courts, the Chief Justice replied that:
Buryatia is not a member of the World Congress, and we do not recognize the legitimacy of the World Congress' Judicial system. Therefore the trial, like any other involving a Buryatian citizen shall take place in Buryatia."-Reporter

Two Buryatian soldiers enter the Courtroom escorting Chernorussian leader ‘Big Brother’ with his lawyer trailing behind him. The Head of Chernorussia’s army was carried in by another set of guards. The panel of judges enter the Courtroom and take their seats at the bench. The leader of the panel then began to speak:

“Good afternoon,

We are gathered here for a simple preliminary hearing into a series of important events. At this session, the State Prosecutor will be required to list charges to be brought against the defendants. After this point, the defendants shall be asked to enter an initial plea of guilty or not guilty to each of the charges to brought against them.

Once this has been done, we will have a brief recess, before we begin opening statements. At this point, I invite the State Prosecutor to begin”-Chief Justice

The State Prosecutor rises and then reads from a list:

“Your Honors, Comrade Chief Justice, Defense Council,

The People bring the following charges against the one called ‘Big Brother’:

1) The murder of a Buryatian Diplomatic Official with Diplomatic Immunity
2) Assaulting a Buryatian Government Official
3) Illegally detaining two government officials
4) The murder of four Buryatian Presidential Guard Units
5) Violating the Independence Treaty signed with Buryatia
6) Directly threatening Sovereign Buryatian Territory
7) Fabricating evidence to justify an act of Chernorussian aggression
8) Espionage
9) Authorizing an act of aggression against Buryatia
10) Endangering Buryatian Peacekeepers

Accordingly, we will wait for a plea from ‘Big Brother’ to all ten of the initial charges.”-State Prosecutor

The Prosecutor takes his seat, as ‘Big Brother’s Defense Council rises and the Court waits to hear his plea.

IC: "While the government of Buryatia will permit a representative from Shinsei Shikkoku Teikoku to provide evidence and testimony, it is not generally the policy of the Supreme People's Court to permit observers to oversee such a high profile trial. The motion to permit such an observer would have to be voted upon by the Court."

I will only point out what is painfully obvious: the Buryatian Royal Guards opened fire on my troops, and in self-defense they fired back. In addition, I fail to remember when two government officials were detained illegally. If you mean when I ordered Onatopp..." he smiled when he saw some snarls among the people. "When I ordered Onatopp to be kept in custody, that was illegal? Then surely it was illegal when Onatopp ordered her armed troops to prevent me from leaving the talks in Buryatia? And we had good cause to believe Onatopp ordered her troops to open fire. Besides..." he suddenly smiled widely. "I am not Big Brother." he grinned even more widely at the incredulous looks of the Buryatians. "No single living thing is Big brother. I was only 'his' public face." he sat down again, and General Kharkov, the leader of Chernorussia's military, stood. By the look on his face, he clearly had not known the information 'Big Brother' had just given.

The Court officials watched the man's speech with neutral expressions on their faces, while the Buryatian non-governmental observers laughed at the events occurring in the court. The Chief Justice spoke to the alleged 'Big Brother':

"The Court has specified that at this time we will be accepting only your plea regarding the charges against you. The time for statements and accounts will come later. We remind the defendants that this Court is government by laws and procedures to which they must adhere. The Court therefore asks, yet again, what is your plea regarding the charges brought against you by the State Prosecutor?"-Chief Justice

"I have said what is needed." he said. "I have no plea. I merely say that half those accusations are false."

"Do you realize that your failure to enter a plea will be taken into consideration by this Court, but will not halt the proceedings? We ask one final time for you to enter a formal plea regarding the charges against you."-Chief Justice.

The Defense Council leans towards 'Big Brother' and asks him to consider a plea of not-guilty for all of the charges.

Regarding the credibility of the claims, the structure of any fair trial permits the defendant to defend himself against the individual charges. "Well, directly threatening Buryatia? If you mean when Chernorussia's troops went to the Buryatian 'base' and asked them to work it out peacefully? Not a single Chernorussian troops so much as coughed at the Buryatians. As for endangering Buryatian Peacekeepers, I say again, you fired the first shots. Your troops, rather than face a day or so in Chernorussian custody, chose foolishly to fire on my troops and me. Knowing they would die. We did not endanger them, they endangered themselves. As for Authorizing aggression against Buryatia, I admit, Big Brother gave authorization to send Chernorussian troops to your base, though we did not open hostilities. And we did violate the Independence Treaty.
About the other accusations...
1) The murder of a Buryatian Diplomatic Official with Diplomatic Immunity:
We believed Onatopp had given the order to fire upon our troops. It was unfortunate but her soldier's foolish actions caused it.
2) Assaulting a Buryatian Government Official
I fail to remember any cases of assault.
3) Illegally detaining two government officials
By illegal, do you mean when I kindly asked Onatopp to remain in custody for refusing to hand over a suspicious object which for all I knew could have been anything? And was it legal for Onatopp to command her troops to prevent me from leaving talks? They crossed their bayonets in front of my path like a commoner. Is that legal, infringing on my rights as a diplomat?
4) The murder of four Buryatian Presidential Guard Units
They opened fire on us when we asked them to go with Onatopp into custody, would you have liked for us to stood in front of them and allowed ourselves to get riddled with bullet?
7) Fabricating evidence to justify an act of Chernorussian aggression
Please tell me what eveidence was 'fabricated' to justify 'aggression'?
8) Espionage
There was no proof of espionage.

We just believe an observer should take place to provide neccessary evidence and testimony to Buryatia, as well as put forth the two charges we currently have existant against this "Big Brother. Those being "Espionage against the state" and "Attempt to murder royal family" as well as "Attempting to hold Imperial hostage"
