I can not spy on a nation I am at war with? He fell out of my range. Does it make any sense not to be able to spy on someone you are at war with?

The spy system is seperate from the war system. As such you can only spy on nations within your strength range. If your war opponent falls out of range you can no longer spy on that nation.
