  2. United Republic of the Phoenix Declaration of Existence We, the United Republic of the Phoenix, do hearby declare our existence. We formed on February 2, 2014. Our alliance came to be after a sudden merger between Promethia and North Star Federation. Knowing that said merger would not only be the end of Promethia, but also something that I as a government member had no previous knowledge of, I, vlasktom, felt that my governmental authority had been violated and decided to leave. [spoiler] Section I: Preamble The United Republic of the Phoenix (henceforth referred to as URP), was founded on February 2nd, 2014 as a successor state by founders Vlasktom, Herr Kohler, Kryskov, Unseen, qwxy and NathanCaelum and is an active yellow sphere alliance. The United Republic of the Phoenix is dedicated to the economic development, management and well being of its member nations. URP also believes that an active military is needed to protect both its investments and members, and those of its allies. URP considers the economic growth of each of its members to be of the highest priority, and that each member is of the utmost importance. The United Republic of the Phoenix will not hesitate to protect its investments and members, and those of its allies, with military force and will do all in its power to end any conflict which arises to threaten the stability of this alliance. Section II: Reaffirmation Article I: The United Republic of the Phoenix, will be, and will forever continue to be the alliance that was envisioned by its founders. URP holds its constitution as the highest document of law within its confines and its members are proud to uphold its letter. Article II: Values of the United Republic URP’s values are what this alliance holds most important. This alliance will be steadfast in the defense and upholding of its values. The disposition in which we earnestly strive to achieve. Through the means of unity and strength will this alliance lay a foundation of serenity and peace that will achieve a stable and secure community that embodies these values. Through these values, The United Republic of the Phoenix will coalesce to foster a friendly and helpful alliance in which to join, work and present the opportunity for individuals to place their input into an alliance which furtively pursues such matters. Article III: Purpose URP's highest priority is the economic and technological development of its members. As well as the protection of its investments and members from any and all threats that arise to threaten the stability of the United Republic. No member may post pornographic images. 2. No member may declare war on another nation without permission. 3. No member may spy on another member nation 4. Treat fellow members and diplomats with respect 5. If you agree to a 'tech deal' you must stick with it By signing up and requesting to become a member of the United Republic of the Phoenix, you agree that: 1. You are not on any active black lists 2. You are not part of another alliance 3. You are not involved in any wars 4. You are not aiding warring nations 5. You are not a target of another alliance 6. You will follow all procedures and laws passed by The URP Government. 7. All previous alliances must be disclosed 8. Your team color is strongly recommended to be yellow, but exceptions are made. 9. You have joined the alliance in game. Final decision will be made by The Senate, an interview by the Senate will be conducted if deemed necessary, or if requested by the applicant. Exceptions to Admission Requirements or Processes can also be requested by the applicant to the Senate. Reason for denial of application may or may not be shared. Any infraction of the Laws, Procedures, Constitution, or Application Process will result in punishment including, but not limited to, expulsion from URP. Section IV: Government of the United Republic of the Phoenix Article I: Government Basics The Senate is the main governing body of the United Republic of the Phoenix. It is composed in order of power, authority and prestige, foremost, the President, the Vice President, and then the Senators and finally, the adjutants. The President will usually preside over all government meetings, but the Vice President may preside in the President's absence. Article II: The Democratic Process The United Republic of the Phoenix is a democracy. All positions in the URP government are elected positions whose holders’ are chosen by the membership of the United Republic. Elections are won by a simple majority. Legislation is voted on and approved by the Senate and the President. Most legislation passes with a simple majority. Article III: The Presidency Subarticle I: The President has full control of the daily operations of the alliance and determines the main objectives the alliance is pursue. The president sets the goals for the alliance and they are the ultimate power in URP, other than the Supreme Court. Subarticle II: The President is able to propose legislation but is not able to vote on legislation. If the president is either for or against something and the majority of the votes went against the president, the president must still sign the bill into law once approved by the supreme court. Subarticle III: The President can veto legislation whenever they feel it is necessary. In order for congress to bypass a veto, a ⅔ majority is required in both chambers and the legislation returns to the house to begin the voting process. If the veto is overridden, the president MUST approve it. Subarticle IV: Executive orders are available to the president twice per term and the president may use them at their own discretion. If the president writes legislation and attaches an executive order to it, the legislation bypasses congress and goes straight to the supreme court. If approved by the court, the bill is now law. If the bill is struck down by the court, the executive order is still exhausted and a new one is not given to the president. Subarticle V: The President is the Commander-in-Chief of the military. As such, they have ultimate say on what goes on in the military. Article IV: The Senate The senate is the senior governing body of the United Republic of the Phoenix. The senate is made up of the Vice President, Minister of Internal Affairs, Minister of Foreign Affairs, Ministers, Minister of Finance, Minister of Defense and the Minister of Education. Each member gets one (1) vote in legislative matters. Any member of the senate may propose legislation. The Vice President is the Senate Chair. Subarticle I: The Vice President The Vice President is responsible for conducting alliance related duties in coordination with the respective heads of each department. The Vice President advises the President, directs the Senate, and promotes government policies. Should the President fall absent or unable to perform his duties, the Vice President shall convene in counsel with the Senate and will gain the President’s position until the rest of the term is finished. The Vice President shall organize the Senate and is responsible for maintaining proper procedure and counting the votes. Subarticle II: Minister of Internal Affairs The Minister of Internal Affairs manages all internal issues of URP. Their responsibilities include reviewing and resolving disputes between members, ensuring compliance with all rules and regulations, monitoring the progression and activity of members, providing assistance and advice to members, ensuring guides are up-to-date and understandable. He will also be in charge of managing the membership academy, mentorship program and bringing any concerns to the attention of the Senate. Subarticle III: Minister of Finance The Minister of Finance is responsible for the organization of finance, trade and technology, both internally and externally. These duties include drafting technology contracts between alliances, importing and/or exporting, actively encouraging members who should sell tech to sell it, assisting members who wish to buy/sell technology. monitoring member’s compliance with technology regulations and acting accordingly. Approving or denying financial aid requests, managing startup-aid payments, providing assistance to members seeking trades and/or circles and ensuring members trade slots are filled appropriately. Subarticle IV: Minister of Foreign Affairs The Minister of Foreign Affairs conducts international relations on behalf URP. Their responsibilities include the drafting, negotiation, and ratification of treaties and agreements, the management of all embassies internal and external and diplomats in conjunction with The President and his/her advisors, and being present on the home and allies IRC channels and handling any disputes that may arise with other alliances. They should also keep track of global news, report to the Senate on how, if at all, it affects the United Republic, and report alliance achievements and news to our allies and friends. Subarticle V: Minister of Defense The Minister of Defense is responsible for the day-to-day military and intelligence activities of the United Republic of the Phoenix. He serves as the leader of the armed forces during war and is responsible for the implementation of military strategy, including the appointment and training of starship leaders. He is chiefly responsible for military and intelligence actions in times of war, answering only to the President. Subarticle VI: Minister of Education The Minister of Education directs URP’s efforts to educate its younger member of the basics of Planet Bob and this alliance. He is responsible for overseeing the entire education process, which includes directing members to the guides, testing members on their knowledge of the basics of CN and instilling young and inexperienced members with extensive knowledge that is needed to be successful in both CN and URP. Article V: Adjutants and the House Adjutants will be subject to the rules and regulations as stated by their Department Leader. They will be constrained to their specific department unless specifically asked to assist elsewhere. Adjutants will serve as assistants to the Senators and members in their respective departments. These positions are to be appointed by the respective Ministers. Adjutants are also full fledged members of the house and have 1 vote each. Article VI: Succession Should the President become incapacitated, the Vice President will become acting leader, and should the Vice President become incapacitated, the remainder of the government body will take direct control of The United Republic of the Phoenix, with each having equal voting power, until such time a special election can be called from within the government body. Article VII: Impeachment Subarticle I: Impeachment is an option available to congress and any one senator or house member may begin the process for impeachment, should enough evidence be provided that impeachment is necessary. Subarticle II: In order to begin the process of impeachment, valid reason must be found that the President is no longer able to lead the alliance. A ¾ majority is required by both chambers of congress to impeach a president. The Vice-President is not allowed to vote in the matter. Subarticle III: Should impeachment pass both chambers of congress, the supreme court will review whether or not the criteria for impeachment were met and whether or not the offense committed by the President was truly one for which they should be impeached. If the court finds that the criteria has been met, the President is removed from power at that moment and the Vice-President assumes the Presidency. The Court’s decision can not be overturned. Subarticle IV: Reasons for impeachment include but are not limited to; Treason, breaches of the constitution of any kind, gross negligence of the alliance, a long period of inactivity that was not given reason for, bribery, and other High Crimes. Subarticle V: Impeachment bars a political official from running from office unless they appeal to the Supreme Court. Section V: No Confidence Vote Any member of the alliance may declare a vote of no confidence on any member of the government. A vote of no confidence will succeed if a ⅔ majority of alliance members, government or not, vote to impeach an official. This process requires no judicial review. Section VI: The Supreme Court Article I: The purpose of a Supreme Court of the United Republic of the Phoenix is to rule on the legality and constitutionality of legislation passed by the URP Government. The Supreme Court will consist of three judges who will be appointed by the President of URP. Article II: All judges who are appointed by the President must be approved by all members of the URP Senate. Justices will be confirmed by a simple majority. All justices are in power until the current leader steps down or should a justice resign, in which case a new justice is to be appointed. If legislation is ruled unconstitutional, the judges must cite their reasoning and the legislation is, from that point on, dead. Legislation is ruled dead by a simple majority in the court. Article III: The justices have final say on the legality of legislation and no legislation that has been struck down by the Supreme Court may be revived by the government. Justices do not have a say in creation process of legislation or the voting process as they must remain unbiased. Section VI: Legislation Article I: The key to a functioning alliance is legislation. Legislation can not be one sided, unilaterally passed with only one featured voice. The democratic system solves this problem in that many opinions are featured in the writing and voting of legislation. Article II: Legislation can be proposed by anybody in the senate or house. Legislation must pass both the house and senate in order to go to the president for approval. Legislation passes with a simple majority. Once approved by the president, legislation is sent to the Supreme Court for review. Once reviewed by the court, the legislation is either approved or struck down by the court. Should the court approve the legislation, the legislation is now law. If the legislation is struck down by the court, the legislation is dead. Article III: If a bill passes one chamber of congress, but not the other, then the bill shall be tabled for a period of 48 hours. During this time, debate on the bill shall be opened. After this period is over, both chambers shall vote once again on the bill. If the bill is not passed the second time, it will be deleted from the agenda. Legislation voting always starts in the house. Section VII: Treaties, Amendments, Wars and Measures Article I: Treaties will require a majority vote by The Senate. Article II: Amendments to the Constitution can be submitted to the Senate for consideration. Amendments to the Constitution require a ⅔ majority vote by the Senate and House. Amendments will then be open to a public referendum for 72 hours, where a simple majority would pass the amendment. All other measures that require official government decision will be decided in the same process as above, with a majority vote by the Senate. Anything passes with a simple majority. Article III: The Senior Command will uphold all contractual obligations to the letter, as specified within the document in question, and as relating to the charter. We also recognize that there be no requirement of a document to come to the aid of our friends and allies if the need arises, whether it be via military need, financial need, or otherwise. Article IV: All members will have direct control over their military, but are expected to mobilize if a war were to occur, members are also expected to follow orders by Minister of Defense and their respective division leaders. Declaring war requires a unanimous vote by The Senate. A unanimous decision must be reached by the Senate within 36 hours. If a unanimous decision is not reached, a vote will go public and a majority of the public can approve a Declaration of War. This vote will last 24 hours. Article V: "Tech-Raiding" is forbidden in URP under all circumstances. All who take part in tech raiding are in direct violation of this constitution and will have their respective memberships revoked. If you are on the receiving end of a 'Tech-Raid', you must bring it to the attention to The Senate immediately. Article VI: Any nation caught ghosting in URP without authorization will be given a chance to either apply for membership, or change AA. If neither is done within an unspecified period of time, said nation will be subject to all means of warfare available, becoming a target of URP, its allies, and friends. Article VII: If an altercation ensues, outside of open warfare, between a member of URP and another legitimately aligned nation, a cease fire order will be given. The cease fire order will remain active until said message is read, at which point a cease fire and delegation for reparations is expected. If the message shows as read without a response from the attacker, or any attacks are conducted after said message is sent, he will be a valid target for all of URP, its allies, and friends. Diplomatic measures between alliance governments will be attempted in addition to the above listed measures. If an altercation ensues between a member of URP and another illegitimately aligned nation, they will become a target of all means of warfare available, becoming a target of URP, its allies, and friends. Article VIII: In the event that a member of URP attacks a legitimately aligned nation, the member will be seen as a rogue nation, and it will be expected that a counter attack would ensue upon the member in question by the nation and its alliance as well as from URP forces. Delegation will be sought in attempt to correct the action, but reparations will not be provided to or from any uninvolved nation. In the event of an open Declaration of War, it is assumed that nuclear weapons can, and will be used, unless specifically stated by the government within the Declaration.[/spoiler]
