Lets say you were convicted of a crime - Regardless of your guilt or innocence, the jury has convicted you, and now you must be sentenced.

If given a choice between 10 years and 10 lashes, which would you choose?

Jail is hell on Earth. Ten lashes would be the lesser evil.

Yea. Hell on earth. If I ever become destitute, and homeless, i'll be robbing a place to get sent to jail.

I'd rather not get raped, killed, or the crap beaten out of me. In jail it's either survive, die, or become somebody's plaything.

A United States Department of Justice report, Sexual Victimization in Prisons and Jails Reported by Inmates, states that "In 2011-12, an estimated 4.0% of state and federal prison inmates and 3.2% of jail inmates reported experiencing one or more incidents of sexual victimization by another inmate or facility staff in the past 12 months or since admission to the facility, if less than 12 months." [2] However, advocates dispute the accuracy of the numbers, saying they seem to under report the real numbers of sexual assaults in prison, especially among juveniles.[3] - Wiki...

The relative safety of a correctional facility changes depending on your race and gender. White males are slightly safer on the streets (4.3 murders per 100,000) than in state prisons (5 murders per 100,000). African-American men, in contrast, are safer in prison. The black murder rate in prison, at 3 deaths per 100,000 prisoners, is slightly lower than the white prisoner murder rate. African-Americans outside of prison, however, suffer a murder rate of 32.1 per 100,000. Women are also safer in prison than on the streets. Between 2001 and 2010, only four women were murdered in prison, for a rate less than 0.5 per 100,000. Outside of prison, 2 women for every 100,000 are murdered each year.

I'm sorry, but you have a very misconstrued version of jail.

On point though. I'd probably take the lashes if I had a stable job, and house for the next ten years. If not, send me to jail.

If your so soft you couldn't take a little whip on the arse then trust me your going to have a hell of a lot of fun adjusting to getting a plastic fork with a Hep C infected razor blade glued to the top jammed down your spine in the exercise yard!

10 lashes of what? A bullwhip? Riding Crop? Rattan Cane? Hippo Hide Whip?

Bear in mind, a good plying of the whip or the cane can flay the meat from the bones. 10 lashes with or without immediate subsequent medical attention?

This. Additionally, where would one receive the lashes? I for one would prefer to be lashed on the arse as opposed to say, the face or genitals.

honestly don't see the point of this. Reminds me of how some states of the US still have castration as a punishment for certain sex offences.

I think the OP is questioning if taking a few lashes actually constitutes cruel and unusual punishment. Western society generally considers any form of physical pain to be cruel and unusual, but given the option of that versus society's accepted form of punishment (jail), many here are in favor of whipping.

Just for the heck of argument, I'll say that I would take jail in hopes that I could clear my criminal record in an appeal; though if I could appeal before or after taking my full whipping punishment I guess I'd go for that. Also have the possibility of parole in jail, if appeals go badly.

And to be clear, we are talking about heavy duty lashes applied to the back; causing wounds and scarring for life. Immediate modern medical attention sans pain relief after the lashing, so you're not going to get infections or anything.

It would suck, but you would probably be healed up after a month or so, vs losing several years to prison and probation. Could make a cool drinking story.

I think the bigger issue is rate of incarceration and the private prison industry though.

Our modern society doesn't mind being cruel to prisoners as long as it's clean and sterilized. We don't like messy executions like firing squad or the guillotine, but we don't mind killing people as long as it's all clean and tidy like lethal injection or the gas chamber. Whipping someone with a barbed cat of nine tails or some !@#$ would be messy (literally, blood everywhere), whereas locking a man in a cage for 10 years of his life is neat and tidy.

It's not about what would be best for society or the convicted, it's about what middle class America wants in terms of their image of themselves.

We might also make the whipping more proportionate to the crime. So many lashes for so many days you would have spent in jail. Let's say, for ten years you would have spent in prison, you need to report to court for a whipping once a week.

Maybe you have just been charged before trial, and you have the option of paying bail with a whipping.

Or maybe you are just being held for a few days before being charged with something. Would you do that, or take a whipping?

Now we're talking unusual. :P
